E-Bike? or Electric Motorcycle? Know the Difference Before You Ride

Did you unwrap a brand-new e-bike this Christmas, or have your eye on giving one as a gift? These modern rides are soaring in popularity across Texas, but before you hit the road or trails, it’s important to understand how state law distinguishes e-bikes from electric motorcycles.

E-Bikes

Under Texas law (TTC 664.001), e-bikes are considered bicycles. They feature pedals and an electric motor not exceeding 750 watts. This means they can be operated anywhere where traditional bicycles are allowed, including trails and bike paths.

Electric Motorcycles

These vehicles pack more power, often exceeding 28 mph and using larger motors. Because of this, they fall under a different set of rules. Electric motorcycles must be registered, insured, and operated only by those with a Class M driver’s license. They’re not permitted on trails or sidewalks but may be used on roadways or private property, like a ranch or deer lease, similar to other off-road vehicles.
